Computer Systems, Upgrades, Repairs, and Hardware
Herein are described the Terms and Conditions of the GeekGenius Enterprises One Year Limited Warranty Agreement (hereinafter referred to as the Agreement), between the Original Purchaser and GeekGenius Enterprises (hereinafter referred to as GeekGenius), for the Product(s) on the attached sales receipt (which must specify which Product(s) are included in this Agreement).
This Agreement is not intended to replace, alter or extend the Original Manufacturer Warranty, if any, except otherwise specifically stated in this Agreement. Only Service which is not covered by the Original Manufacturer Warranty is covered by this Agreement.
This Document and applicable sales receipt must be present with any claim requested.
1.01.1: Product Eligibility for Service
Only Product(s) supplied to the Customer by GeekGenius at the Customer’s charge are applicable, but that does not automate eligibility. Only the Product(s) specified on the GeekGenius sales receipt to be applicable are applicable. Product must be in proper operating condition at the time and date of purchase (used Product(s) are NOT applicable to this agreement.) Computer Systems, which are constructed and set up by GeekGenius for the Customer, are applicable to this Agreement, only if the customer does not refuse to PURCHASE this Agreement at the time of purchase of the Computer System(s). Under normal circumstances this Agreement is automatically included with the purchase of a computer system constructed and setup by GeekGenius for the Customer at the customer’s charge. NO USED PARTS ARE EVER APPLICABLE TO THIS AGREEMENT.
1.01.2: Period of Coverage
This Agreement shall commence on the original date of purchase of the Agreement and shall terminate on the first anniversary unless otherwise specified on the attached sales receipt. This Agreement is not valid after the first anniversary of the original purchase date.
1.01.3: Service Provided
GeekGenius will provide the labor and furnish the parts to maintain the Product(s) in proper operating condition, if the Service required is not covered by the manufacturer’s warranty, according to the terms and conditions contained within this Agreement. Depending on the product the parts may include printed circuit boards, electronic components and any other parts that may be included in the Product(s) which are covered by this Agreement as required to maintain the Product(s) in proper operating condition.
1.01.4: Exclusions from Service
Service provided under this Agreement is contingent upon the proper use of this Product(s) in a proper operating environment. This Agreement does not cover:
- damage to the Product(s) due to fire, flood, misuse, neglect, humidity, failure or fluctuation of electrical power, accident, insect infestation, damage resulting from accessories or attachments, or element(s) of nature,
- repair or replacement of expendable items including, but not limited to batteries,
- routine cleaning and maintenance, preventative maintenance other than provided herein, or "check-outs",
- refinishing or replacement of cosmetic parts,
- installation, removal, or reinstallation of Product(s) or damage to Product(s) resulting therefrom,
- Product(s) that have been altered or modified.
1.01.5: Replacement of Parts or Product(s)
- If Service requires replacement of any parts, components, circuit boards, units, modules, or Product(s), the replacement item(s) become the property of the owner of the Product(s) and the replaced items become property of GeekGenius.
- GeekGenius may use new, used, or reconditioned parts, components, circuit boards, units, modules, or Product(s). Replacement item(s) shall be of like kind and quality of those replaced.
- The right to replace Product(s) which are deemed by GeekGenius to be uneconomical to repair with a comparable substitute is reserved.
- GeekGenius shall make selection of substitute Product(s).
- Substitute Product(s) shall be eligible for Service to the same extent as the original Product(s), for the remainder of the unexpired term of this Agreement.
1.01.6: Limitation of Liability
The sole responsibility of GeekGenius under this Agreement shall be limited to providing Service or replacement of Product(s) as set forth herein. GeekGenius DISCLAIMS ANY OTHER LIABILITY OR RESPONSIBILITY TO CUSTOMER OR ANY OTHER PERSON OR ENTITY WITH RESPECT TO ANY LIABILITY, LOSS, OR DAMAGE CAUSED OR ALLEGED TO BE CAUSED DIRECTLY OR INDIRECTLY BY GeekGenius, OR REPLACEMENT PARTS, PRODUCT(S) OR SERVICE PROVIDED BY GeekGenius AND IN NO EVENT SHALL GeekGenius BE LIABLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY BREACH OF THIS AGREEMENT. GeekGenius shall have no liability or responsibility to maintain or restore computer programs or data to protect against loss.
1.01.7: General
- This Agreement is the entire Agreement between the parties and supersedes all other verbal or written agreements and understanding, either written or verbal, concerning the subject matter herein. This Agreement (including this paragraph) may not be modified.
- The terms and conditions of this Agreement shall prevail over any conflicting, additional, or other terms appearing on any purchase order submitted by the Customer at any time.
- The right to subcontract any service under this Agreement is reserved.
